  • You are welcome to link to our website (as long as our destination URL is clearly displayed in the address bar). You are welcome to use a copy of the onlinelegal.com.au and LawPacks® logos but only for the purposes of that linking. We reserve the right to require that you cease and remove links or logo use at any time.

5. Payment & Accepted currency

  • Subscribers to onlinelegal (not pay as you go (PAYG) customers) authorise onlinelegal.com.au to charge their credit card at month end for all purchases made and monies owing.
  • Currency of all transactions is in Australian dollars (AUD).

6. Australian Goods and Services Tax

  • Transactions will attract Australian Goods and Services Tax (GST). The current rate of this tax is 10%.

7. Contract & Delivery

  • A legal agreement/contract is made at the point of your order (which is an acceptance of an offer made on this website). Delivery of products to you will usually be via email.
  • Arranging for special delivery will incur an additional delivery fee.

8. Links

  • Links and third party products and services are provided for your convenience. We cannot however guarantee their content or uptime.

  • You acknowledge that onlinelegal.com.au are not liable for any:
    1. delays, failures, interruptions, computer viruses or communication line failures; or
    2. damage or unauthorised access to your computer system or network.

  • You agree to indemnifyonlinelegal.com.au (our directors, parents and affiliates and their respective officers and employees) against any cost incurred or damage or loss suffered by onlinelegal.com.au (our directors, parents and affiliates and their respective officers or employees) as a result of your breach of obligation.

  • You acknowledge that onlinelegal.com.au may at any time terminate without notice, your access to and use of this website for any breach of these terms and conditions or any other arrangement that you have with us.

  • You agree that onlinelegal.com.au will track usage of this website and its products and services.
  • You agree that onlinelegal.com.au will keep records of online usage and will tag products to ensure the quality and to protect from unauthorised use.

  • These Terms and Conditions are non-exhaustive and you agree to be bound by any other additional terms and conditions that appear on this website (or are otherwise communicated to you).

23. Contract for the benefit of Third Parties

Contracts formed with users of this web site are also for the benefit of the following person(s) and entity(ies)

as if those person(s) or entity(ies) stood in our shoes.


Agreement (only relevant to online Companies & Trusts products) purchased through document build forms on this site (if any)

 

Once you Save & Finish the document build form your order will be emailed to the owner of this shop. The Shop Owner will then be in touch with you. (The Shop Owner may elect not to accept the job. The Shop Owner will inform you of this.)

 

The cost quoted by the Shop Owner includes Shop Owner assistance and advice to deliver the product ordered to you. The scope of what is included will be made clear at the time of the quote.

 

You should clarify with your advisor (Shop Owner) whether the cost includes asset protection advice, amendment of the base documents or tailoring of the documents to your particular circumstances. These costs will be additional at the usual rates of your advisor. These will need to be clarifies and agreed with your advisor.

 

You may contact the Law Society / Institute or Legal Services Commission in your State or Territory if you have a complaint about the fees and costs charged or the work performed by your advisor.

 

Your advisor may keep your file until you pay all  costs or reach an agreement about paying them. 

 

You agree to Cleardocs Pty Ltd sending your contact details to us and the Shop Owner.

 


Shop Owners (Customised Online Legal Shop) - additional Terms & Conditions

A.   A unique tracking code will be sent to Shop Owners by us. This will identify a Shop Owner as the source of buyers making their purchases through their Customised Online Legal Shop. Shop Owners are responsible to ensure that identifier is placed in the url of the link that comes to our site.

 

B.   The current commission stream applicable to Shop Owners is as follows:

(i)              on a sale of a PAYG LawPacks through your Customised Online Legal Shop, a 30% commission on the ex-GST sale price of the LawPack; and

(ii)              on a sale of online Companies, Trusts, Super and Division 7A products through your Customised Online Legal Shop, a 10% commission on the ex-GST base sale price of those products.

 

No commission is payable on PAYG Searches.

 

C.   Only transactions made through the Customised Online Legal Shop of a Shop Owner are applicable for any relevant payment of commission. Where a customer chooses to make a purchase directly from us, or from any other authorised distributor of LawPacks, a Shop Owner will not receive any commission on such sales.

 

D.   Commission payments will be made to Shop Owners on a monthly basis via direct banking into your nominated bank account on receipt of the Shop Owner's tax invoice. You are responsible for keeping us advised of your current BSB and Account number for this purpose.

 

E.    We remind Shop Owners that the Terms and Conditions for use of this site apply to them as well as their customers.

F.    We may modify / alter any of theses additional terms and conditions of this agreement at any time and at our sole discretion by posting them on this site.

If any such altered term is unacceptable to a Shop Owner they may terminate their agreement with us by providing us with written notice of intent to terminate.

 

Continued participation as a Shop Owner following our posting of any alterations / modifications made known to you, will constitute your binding acceptance of the change /alteration / modification.

 

G.     If you cease being a Shop Owner at any time during your current subscription period no part of the annual fee is refundable.

 

H.     The annual subscription fees for new and renewing Shop Owners are subject to review (both on a general and a subscriber by subscriber basis) in our absolute discretion.

 

I.      Annual subscription fees must be paid in full in advance. Without limitation, failure to pay will result in deactivation of your Customised Online Legal Shop.

 

J.    A Shop Owner may not assign its agreement with us without our prior consent. We may assign our rights and obligations simply by notice to you. We are then relieved from any liability there after.
